United States Attorneys Obscenity Prosecution Record for Fiscal Years 1993-2001

Prosecutions means cases in which the lead charge was under one of the obscenity sections, Sections 1460-1468 of Title 18 of the United States Code. Convictions means guilty pleas or jury convictions for violations of Sections 1460-1468. Referrals mean criminal referrals from federal law enforcement agencies to U.S. Attorneys' offices for the purpose of initiation of prosecution. Declinations are refusals to initiate prosecutions based on referrals from federal law enforcement agencies.

Following are the 93 U.S. Attorney's offices, with addresses and telephone numbers, the current U.S. Attorneys (as of December 2001), and each office's record of obscenity enforcement during the fiscal years 1993-2001.

The U.S Justice Department obscenity enforcement records were obtained by MIM from the Transactional Records Access Clearinghouse (TRAC) at Syracuse University.

Note: Data for FYs 1999-2001 were delayed for several years because the Executive Office of U.S. Attorneys at the U.S. Justice Department refused to supply complete data records to TRAC. TRAC initiated a Freedom of Information Act lawsuit in U.S. District Court in Washington DC against DoJ and the EOUSA to obtain the complete records. In late September 2001, the DoJ released more than 300 data tapes to TRAC. TRAC has news releases on its Web site describing its success in obtaining the data tapes and its Freedom of Information Act court battle against the EOUSA.

Districts marked with the symbol are the 45 districts which did not initiate even one Federal prosecution from FY 1993-2001, in which the lead charge was a violation of a Federal obscenity statute.

In some districts, (e.g., Arizona) the number of convictions is greater than the number of prosections. This reflects prosecutions initiated in previous years.

Note: The list of addresses was updated 4 June 2002. Most of these U.S. Attorneys have been appointed by the George W. Bush Administration. The prosecution records below would not necessarily reflect the policy of a recently-appointed U.S. Attorney.
